Terms of Service

Last updated: October 15, 2026

These terms govern your use of Telemetry Machine's website, hosted observability platform, and APIs (the “Service”). “We,” “us,” and “our” mean Telemetry Machine, Inc. By creating an account or using the Service, you agree to these terms. If you use the Service for an organization, you must have authority to accept them for that organization, and “you” includes that organization. A separate agreement signed by both parties takes priority where it conflicts with these terms.

1. Accounts and access

You must be at least 18 and legally able to enter into this agreement. Provide accurate account information, keep your credentials and API keys secure, and tell us promptly about unauthorized access. You are responsible for your users, integrations, and activity under your account. Your organization's administrators control membership and access to its data.

2. Using the Service

You may use the Service for your business purposes, subject to these terms, the documentation, and your plan's limits. Do not use it unlawfully, infringe another person's rights, upload malware, access another customer's data without permission, bypass security or usage limits, or interfere with the Service. Do not resell the Service without our written agreement or reverse engineer it except where the law permits. These restrictions do not override rights granted by an applicable open-source license.

3. Your data

You retain ownership of the logs, traces, metrics, and other content you submit, and of your query results. You give us permission to store, process, and transmit that data only as needed to provide, secure, and support the Service, or as required by law. We retain ownership of the Service and its software. We may use feedback you voluntarily provide to improve the Service without owing compensation.

You decide what data to send and are responsible for having the necessary rights, notices, and permissions. Minimize personal information in telemetry. Do not send passwords, private keys, payment card details, health information, or other sensitive or specially regulated data unless we have agreed in writing to support it. If your use requires a data processing agreement, contact us to arrange one before sending personal data subject to that requirement. Our Privacy Policy explains how we handle personal information.

We will treat non-public customer data as confidential and limit access to people and service providers who need it to perform the activities above and are bound by confidentiality duties. We may disclose data when legally required and, where legally permitted, will notify you of a compulsory disclosure. Data retention is governed by your plan and settings. Keep independent copies of anything you need to preserve; the Service is not a backup or permanent archive.

4. Free trial

Each new organization can try the Service free for 14 days. You do not need to provide a payment method to start the trial, and we do not charge for it. During the trial you can use the Service's features, subject to any usage limits shown in the Service. Each organization gets one trial, and we may end a trial early if it is used to abuse the Service or to get more than one trial.

The trial ends after 14 days or when you subscribe to a paid plan, whichever comes first. A trial never becomes a paid subscription on its own; you are charged only after you choose a plan and add a payment method. If you do not choose a plan by the end of the trial, we stop accepting new data for your organization and may restrict access to the Service. Data sent during the trial is then deleted under our retention practices.

5. Plans and fees

Paid plans are billed monthly. Each plan's monthly price covers an allowance of events and a number of SLOs, as listed on our pricing page when you subscribe or change plans. Each span, log record, or other event counts as one event, and each metric data point counts as one fifth of an event. Every plan includes 60 days of data retention and unlimited users. Each SLO beyond your plan's included SLOs costs US $10 a month.

On the Scale plan, events beyond the monthly allowance are charged at that plan's per-million rate. Other plans do not charge for events beyond the allowance. If your usage on one of those plans regularly exceeds its allowance, we may ask you to move to a plan that covers it, and if you do not, we may limit the data we accept above the allowance.

By subscribing, you authorize us and our payment processor to charge your payment method each month: the plan price at the start of each billing period, and any charges for extra SLOs or additional events at the end of the period in which they were incurred. Your subscription renews each month until you cancel it. Upgrades take effect immediately; downgrades take effect at the start of the next billing period. A separate order or signed agreement may set different prices or billing terms.

Prices exclude applicable taxes, which you agree to pay, except taxes on our income. We will give at least 30 days' notice of price increases for an existing paid plan, which take effect no earlier than its next billing period. If a payment fails, we will notify you and may suspend paid access until overdue charges are paid.

You can cancel your subscription or request account closure by emailing [email protected]. Cancellation stops future renewals; charges already incurred remain due. Unless your order or applicable law says otherwise, paid access continues until the end of the billing period and fees are not refundable.

6. Changes, suspension, and termination

We may update the Service and change or discontinue features. We will give reasonable notice of changes that materially reduce a paid service. We may restrict or suspend access to address a security risk, unlawful activity, or a breach of these terms, and restore access when the issue is resolved. Where practical, we will notify you and give you an opportunity to fix it.

Either party may end this agreement by notifying the other. If we end a paid service for our convenience, we will refund prepaid fees for the unused period. Retrieve any data you need before closure; access ends when the account closes and data may then be deleted under our retention practices. If we initiate closure, we will give a reasonable opportunity to retrieve data unless doing so would create a security risk or violate the law.

7. Availability and responsibility

Unless separately agreed in writing, the Service is provided “as is” and “as available,” without a service-level guarantee. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted operation, error-free results, or that every event will be ingested or retained. You are responsible for decisions you make using the Service. Third-party products and integrations you choose are governed by their providers' terms.

To the extent permitted by law, neither party is liable for indirect or consequential losses, lost profits, or lost business arising from this agreement. Our total liability arising from the Service or these terms is limited to the greater of US $100 or the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms excludes liability for fraud or any liability or rights that cannot lawfully be limited or excluded.

8. General terms and changes

These terms and any applicable order or signed agreement form our agreement for the Service. If a provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a provision does not waive it. Provisions about ownership, confidentiality, outstanding payments, and liability survive termination.

We may revise these terms. We will update the date above and notify account holders by email or in the Service at least 30 days before material changes take effect, unless a legal or security requirement needs an earlier change. Continued use after the effective date means you accept the revised terms. If you disagree, you may stop using the Service and cancel.
